1. Acceptance of Terms

By accessing or using MySpot (“the Service”), operated by Kwata Team, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

MySpot is a queue management and appointment scheduling platform that provides:

  • Virtual queue management for walk-in businesses
  • Online appointment booking and management
  • AI-powered two-way SMS communication for scheduling
  • Automated appointment reminders and confirmations
  • Customer feedback collection
  • Business analytics and reporting

3. User Obligations

As a user of the Service, you agree to:

  • Provide accurate and complete information
  • Use the Service only for lawful purposes
  • Not attempt to gain unauthorized access to any part of the Service
  • Not use the Service to send unsolicited communications
  • Comply with all applicable laws, including CASL and TCPA for SMS communications

4. SMS Communications

By providing your phone number and opting in to SMS notifications, you consent to receive text messages from MySpot related to your appointments and queue status. Standard message and data rates may apply. You can opt out at any time by replying STOP.

5. Business Operator Responsibilities

If you are a business using MySpot to manage your customers, you agree to:

  • Obtain proper consent from your customers before adding them to the platform
  • Use customer data only for legitimate business purposes
  • Comply with all applicable privacy legislation (PIPEDA, GDPR as applicable)
  • Not share customer data obtained through the platform with unauthorized third parties

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Kwata Teamand is protected by international copyright, trademark, and other intellectual property laws.

7. Limitation of Liability

To the fullest extent permitted by law, Kwata Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

8. Termination

We reserve the right to terminate or suspend access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to conflict of law provisions.
